If 2022 marks the 1st stage of the Tertiary Decree, with the reporting of 2020 & 2021 consumption data in Operat, 2027 will mark the real implementation of the reduction strategy. By September 30, 2027 at the latest, each taxable person must submit their technical modulation file.

Modulation technical files
Modulating objectives is a possibility authorized by the tertiary eco-energy system. The Method Order (article 9, 10, 11) sets the conditions for such modulation for reasons:
- Volume or change of activity
- Technical (specific and regulatory constraints), architectural or heritage (e.g. listed buildings)
- Manifest disproportion of the cost of actions compared to the expected savings
Each taxable person must justify these modulations on the technical file with these elements:
- An employee demonstrating the required skills
- A certified design or engineer office
- A specialized architect who delivers a detailed opinion
Modulation of objectives can only be invoked when the gross return on investment time of the overall cost of one of the three levers of energy performance improvement actions, after deduction of financial aid, is greater than:
- 30 years for renovation actions relating to improving the energy and environmental efficiency of buildings relating to the envelope;
- 15 years for work to renew building energy equipment (excluding consumables);
- 6 years for the implementation of a control system and active management of systems and equipment.
