Tertiary Decree: and now for the audits

The home stretch has begun: the first deadline for the Tertiary Eco Energy Decree is here on December 31. The ministry has granted an additional 3 months to calmly finalize your triple declaration on the Ademe Operat platform:

  • Reference year consumption
  • Energy consumption 2020
  • Energy consumption 2021

And now ? This is only the beginning of the process. After this first regulatory deadline, it is a matter of implementing and beginning your trajectory of reducing consumption to achieve your objectives by 2030, then 2040 and 2050:

In relative value from -40% to -60% or in absolute value depending on the category of your buildings.

1st step: carry out an audit of your buildings

This audit makes it possible to measure energy consumption very precisely according to

  • the chosen perimeter (park or site by site)
  • depending on the building and equipment
  • by fluid (electricity, gas or fuel oil)
  • by uses (heating, air conditioning, lighting, electrical equipment).

The audit allows you to model your consumption reduction trajectory with comparisons compared to reference situations (in particular the reference year determined on Operat), to identify potential savings to be made in kWh, CO2 and euros. , and finally to prioritize packages of actions to be triggered in order to respect the objectives defined by OPERAT.

2nd step: Follow your consumption reduction trajectory

The Tertiary Eco Energy System is a regulation which involves long-term monitoring of your buildings. 2022 is only the first deadline on OPERAT.

Once energy performance actions have been implemented, you regularly monitor your consumption and their impact in kWh in relation to your objective assigned on OPERAT. This monitoring via our specific module offers you regular reporting on the progress of your trajectory and allows you to declare your consumption each year on the Ademe platform. You thus comply to obtain your annual certificate, certifying your reduction in consumption.

Otherwise, you risk penalties of up to €7,500. And your assets will be devalued financially.

3rd step: Prepare a technical modulation file

In your fleet, you may have certain subject buildings on which achieving the objective set by OPERAT will be more complex due to multiple constraints:

  • heritage constraint on a listed historic building for example
  • architectural constraint
  • constraint for economic disproportion if achieving the objective represents a disproportionate cost

It is then possible on these buildings to adjust your consumption reduction objectives. By justifying it with a technical modulation file to be submitted in 2026.

This file must include:

  • a technical study
  • a detailed opinion justifying the modulation of the objectives according to architectural or heritage constraints
  • a note for calculating the gross return on investment times in the event of a
    manifest disproportion of the cost of the actions compared to the benefits
