What is the BACS decree?
The objective of the BACS Decree, more precisely, is to generalize the energy management of energy-consuming equipment installed in buildings for tertiary use, via the installation of GTB (Technical Building Management) systems.
Owners will therefore now have to equip themselves with a GTB to drive:
- Heating, air conditioning, ventilation,
- The production of domestic hot water,
- Integrated lighting,
- On-site electricity production,
- And any system combining these systems.
What are the deadlines set by the BACS decree?
The BACS Decree timetable has three major deadlines:
- From April 8, 2024 New buildings whose equipment has a cumulative nominal power greater than 70 kW must be equipped with BMS.
- From January 1, 2025 Existing buildings whose equipment has a cumulative nominal power greater than 290 kW must be equipped with BMS.
- From January 1, 2027 : Existing buildings whose equipment has a cumulative nominal power greater than 70 kW must be equipped with BMS.
Good to know: Buildings, new or existing, whose installed power does not exceed 70 kW are not concerned.
How to be exempt from the BACS decree?
If it is not possible to install a BMS for technical or economic reasons, the building may also be exempt. To do this, the owner must prove that the operation cannot be carried out with an ROI of less than 10 years.
Who is affected by the BACS decree?
The BACS Decree is aimed at both businesses and communities and covers a wide typology of buildings: hotels, offices, shopping centers or establishments open to both the public and the private sector, for example; and hospitals, town halls or schools in particular, on the community side.

How to finance the installation of a GTB in 2024?
Several grants and financing options are available to help landlords comply with the BACS Decree.
The CEE bonus (Energy Savings Certificate) is one of the main mechanisms. It makes it possible to finance a significant part of the work and its amount is fixed according to:
- The geographical area,
- The surface of the building,
- The sector of activity,
- The lifespan of the GTB.

Until June 30, 2024, the CEE bonus is increased:
- The amount of aid is multiplied by 2 for the installation of a BMS.
- The amount of aid is multiplied by 1.5 for the upgrade of an existing GTB.
Beyond that, there is no guarantee that the bonus will be renewed!
Extension of the bonus to the CEE premium: what changes compared to 2023
The bonus to the CEE premium has therefore been extended to the first half of 2024 but certain buildings are now excluded from the enhanced system. This is the case for logistics warehouses, as well as community sports equipment.
