Since 09/30/2023, companies or communities subject to the Tertiary Decree must have declared their 2022 consumption on the Ademe OPERAT platform.
And now it's time to take action to improve the energy performance of your buildings and thus achieve the objectives set by the Tertiary Eco Energy Decree.
How to respect the tertiary decree?
The key element for defining the range of actions is the energy audit.
audits on our SAAS Data MARC software allow you to simulate the implementation of a predefined scenario or compose your bouquet of actions with financial projections and energy savings, according to your ROI and objectives linked to the Tertiary Decree.
At Sobre Energie, our digital audits are integrated into our energy management platform, within a specific module.

Once your action packages have been determined, it is possible to obtain several types of financing thanks to our partners:
Energy Savings Certificates
It is possible to promote certain work via Energy Savings Certificates (EEC). Thanks to the CEE , the State obliges energy and fuel suppliers (the “obligated”) to help consumers save energy . Both businesses and communities are eligible, through our Energy Savings partner (EDE) .
For example, with the installation of a BMS (Technical Building Management) to centralize the management of heating, cooling and lighting equipment. A GTB can provide savings of up to 30% on a tertiary building . And this investment can be financed in the CEE with the BAT-TH-116 form, enhanced until the end of 2023.
The amount of the energy bonus is calculated based on the volume of energy saved estimated at the end of the energy renovation work carried out. This calculation is based on the unit of measurement kilowatt hour (kWh) Cumac .
The term Cumac comes from the contraction of “cumulative” and “discounted”. In other words, 1 kWh Cumac is one kilowatt hour saved during the lifespan of the installed equipment and taking into account the evolution of performance of new equipment appearing on the market.

Intracting Device
The Banque des Territoires also finances energy renovation work for all types of local authority buildings:
- City hall
- Administrative building
- Sports equipment
The intracting system consists of establishing a common budget (community + Territorial Bank) to finance energy performance actions. The energy savings generated will then be used to reimburse the Banque des Territoires later.
Sobre Energie acts as a trusted third party for monitoring energy performance actions. Small equipment can be financed by this incentive system:
- IoT sensors
- Installation of thermostatic valves
- Installation of GTB
- Boiler change
The intracting system can also be shared between several communities.
