Tertiary Decree: everything you need to know about the Operat platform

Who is affected?

All owners or tenants of tertiary buildings of more than 1000m2:

  • offices
  • administrative buildings
  • schools, colleges, high schools, universities
  • hospitals,
  • shops
  • museums

What is the perimeter?

By September 30, 2022 at the latest , you must enter the reference consumption of your tertiary buildings in the OPERAT platform

The reference year must be a full year (12 consecutive months of operation) located between 2010 and 2020. The year 2020 is not considered a representative year, due to the Covid 19 crisis. It must be indicated on OPERAT:

  • the type of activity (offices, administrations, schools, etc.)
  • location
  • the surface
  • usage intensity indicators

The energy consumption taken into account concerns 2 fields:

  • All uses relating to the general thermal environment and the ventilation of the premises. This taking into account the occupancy conditions: heating, cooling, lighting, production of domestic hot water and auxiliaries (pumps and fans)
  • Other real estate uses : elevators, escalators, fire safety, security, etc.

What is the objective to achieve?

It is from your reference consumption that the objectives to be achieved by 2030, 2040 and 2050 will be calculated.

-Is a level of final energy consumption in “relative value”, respectively of

  • -40 %
  • -50 %
  • -60 %

-Or a level of final energy consumption fixed in “absolute value”. This threshold is set according to several criteria:

  • the type of activity carried out in the building
  • its geographical area and altitude

It is necessary to refer to the latest decrees published on absolute values .

What happens next?

Once your objective is set, Sobre Energie helps you report your energy consumption data, month after month on the OPERAT platform.

Depending on the progress of energy performance, Ademe will publish an energy performance certificate each year for each building. It will be accompanied by a “Tertiary eco energy” note. It will attest to progress in the process of reducing consumption.

Who checks the consumption data for the reference year on the OPERAT platform?

The control mission is carried out by the competent Prefect, depending on the location of the buildings.

The owner or tenant of the buildings concerned must be able to provide supporting consumption data for the reference year. Upon simple request from the administrative authority and within 3 months. Random checks may be carried out each year to verify the accuracy of the information.

The names of poor performers may be made public. In addition to the fines provided for in the event of non-compliance with the objectives:

  • up to €1,500 for individuals per site
  • up to €7,000 for legal entities per site

The negative “Eco tertiary energy” rating will be attached to the sales and rental documents of a building: this will devalue the heritage value of the property.
