BACS decree: is GTB compulsory for SMEs and mid-sized companies?
Understanding the BACS Decree
The BACS Decree (Building Automation and Control System), resulting from the Tertiary Decree, became effective on July 21, 2021. It requires owners of tertiary buildings, whether new or already existing, to equip themselves with a BMS.
You have until:
- April 8, 2024 for new buildings whose equipment has a cumulative nominal power > 70 kW
- January 1, 2025 for existing buildings whose equipment has a cumulative nominal power > 290 kW
- January 1, 2027 for existing buildings whose equipment has a cumulative nominal power > 70 kW
Good to know: The BACS Decree only focuses on the most energy-consuming equipment:

SME-ETI: who is affected by the BACS Decree?
SMEs and mid-sized companies with tertiary buildings are affected by the BACS Decree. If the rated power of the equipment exceeds the thresholds mentioned, they must comply with these regulations.
The buildings can be businesses, offices, warehouses, hotels, sports or medical facilities, establishments open to the public, etc.
Good to know: if the ROI for the installation of a GTB exceeds 10 years, the building concerned is exempt.
SME-ETI: who is affected by the BACS Decree?
Under the BACS Decree, companies have the choice between different classes of BMS depending on their specific needs. Classes A and B, compliant with standard NF EN ISO 52120-1: 2022, are the most appropriate to guarantee high energy performance.
