The Bacs Decree: Your obligations in 2025 and 2027

The Bacs decree requires the installation of automation and control systems of the building technical management type (GTB) to optimize the energy performance of tertiary buildings.

Here is a complete FAQ, based on the latest information from the Ministry of Ecological Transition , to anticipate your regulatory obligations.

Is my building concerned by the Bacs decree?

What is a bins?

The “bins” (Building Automation and Control System) or “Automation and Building Control Systems” make it possible to control the technical building installations and can contribute to a rapid energy gain at a reasonable cost. They include all products, software and engineering services capable of supporting efficient operation on the energy (optimal energy efficiency (optimal energy efficiency) of building technical systems by means of automatic orders and facilitating manual management of these technical building systems, allowing:

  • Continuous adaptation (automatic regulation, including enslavement) of technical systems according to real needs, external conditions and conditions of use;
  • Energy monitoring;
  • Supervision and optimization of operation;
  • Intervention and human management.

How do I know if my building is subject? 

Your building is subject if the useful nominal power of your CVC systems (heating, ventilation, air conditioning) is:

  • Greater than 290 kW on January 1, 2025
  • Greater than 70 kW on January 1, 2027

Make the estimate of cold power on the one hand (and ventilation combined with the cold if necessary) and the hot power on the other hand (and from the ventilation combined in the warm if necessary): if one or the other is greater than 290 kW (or 70 kW depending on the due date), the building is subject to the decree.  

My building is for mixed use hosting a tertiary activity, am I subject?

A building for mixed use (including for main use of housing or industrial) which hosts tertiary activities is potentially subject as soon as the tertiary part of the building is equipped with a heating system (combined with a ventilation system, if applicable) or an air conditioning system (combined with a ventilation system, if applicable) whose nominal calorific power, or refrigerant zones/buildings exceeds the threshold provided by the decree.

This power can be determined from the existing sub-count devices, if applicable. Otherwise, it can be established either thanks to the supply of a thermal calculation note for new or renovated buildings, or by the application of the method defined to the decrees of July 24, 2020 relating to "controls" and "maintenance" of boilers and thermodynamic systems. If none of these methods is applicable, the power can then be estimated in proportion to the surface served.

How to calculate the useful nominal power?

What should I add?

Add the useful (and not installed) powers of all generators: heat pumps (CAP), boilers, air treatment plant (CTA), etc. All fixed thermal systems must be taken into account.

The so -called "rescue" equipment (equipment normally stopped, intended to replace one or more momentarily unavailable equipment. A rescue system must not appear in a cascade and must be able to be started after the appearance of a defect on the main system only) is not to be recorded in the assessment of the nominal powers.

Example 1: In the case of a boiler room equipped with three boilers of the same power, one of which is considered as emergency equipment, the power to take into account will be as much equal to the ⅔ of the power of the boiler room.

Example 2: In the case of a boiler room equipped with two boilers of the same power, if the regulation allows the two generators to be called simultaneously, then none of the generators can be declared as "aid". In this case the power to be taken into account is the sum of the two generators.


I manage several buildings, should I combine everything?

No. You must analyze building by building, unless the same system feeds several buildings. In this case, the total power of this system applies to each building concerned.

Example 1: If three buildings whose hot or cold needs are provided by a collective production with a power of 150kW, then the nominal power useful to take into consideration for the determination the subjugation of each of the buildings is 150kW, and not 50kW.

Example 2: If two buildings of the same site are connected to an urban heat network, via a single delivery point with a 300kW primary exchanger, then the two buildings have been subject to the Bacs decree since January 1, 2025, even if one of the buildings has an independent sub -station fueled by this primary interchange.


 What are the features required for the GTB? 

 What are the minimum criteria imposed?

A GTB type bins system must fulfill the 4 functions defined by the decree of July 21, 2020:

  • Follow, record and analyze continuously, by functional zone and an hourly time step, production data and energy consumption of building technical systems and adjust (continuous adaptation of technical systems according to real needs, external conditions and conditions of use) technical systems accordingly. This data is kept on a monthly scale for five years.
  • Locate the energy efficiency of the building in relation to reference values, corresponding to the energy studies or characteristics of each of the technical systems. They detect the loss of efficiency of technical systems and inform the operator of the building of the possibilities of improving energy efficiency
  • Be interoperable with the different building technical systems
  • Allow manual stop and autonomous management of one or more building technical systems

Is a class C GTB in accordance with the Bacs decree?  

In order to meet the requirements of the Bacs decree, the NF EN ISO 52120-1 standard can be used. In this case, the level reached by the different features of the standard makes it possible to deduce the class of the bins in a global manner on a building scale.

A class C system within the meaning of standard NF EN ISO 52120-1 respects the Bacs decree provided that all the requirements of the decree: On the regulation functions the class C, or equivalent is enough but the decree requires that the management function function (7.1) is class B, or equivalent, and that the management of operating time and report of information concerning energy consumption and internal conditions (7.2 and 7.4) be class A, or equivalent.  

Is an existing GTB sufficient? 

Only if it satisfies the 4 functions mentioned above. Otherwise, an upgrade is necessary.  

What are the deadlines and terms of compliance?  

What are the deadlines?

Before January 1, 2025 for installations> 290 kW

Before January 1, 2027 for those> 70 kW

Immediately for any new installation> 70 kW put into service since July 21, 2021 

My renovation project provides for an upcoming replacement: Can I wait? 

Only if this replacement is made and carried out before the regulatory deadline. Otherwise, the equipment of a compliant GTB remains compulsory.

Can I phase my project?

Yes, provided you respect the deadlines. For large real estate parks, a progressive strategy is recommended.   

Tenant or owner of the building, who is responsible?  

It is to the owner (s) of the systems to make the compliance with the decree and to connect all the systems of one or more buildings subject to the Bacs decree.

In the event that several owners of technical systems occupy the same building, the sum of the thermal or refrigerated powers of all the equipment should be taken into consideration in order to assess the submission to the decree. If the sum of the powers exceeds the subjugation threshold, then each owner must connect all of his equipment to the bins.

In the event that all systems are entirely independent and do not cover identical areas or uses, each owner of technical systems can have its own bins. However, in the event that systems are interdependent or cover common areas or uses, the bins system must be shared or at least the systems will have to communicate with each other. 

What controls? What supporting documents? 

A periodic inspection of the bins is compulsory every five years, since January 1, 2025. It may be relevant to have the This inspection by a third party independent of manufacturers and bins installers.

Following the installation or modification of the bins or a technical system to which the bins is connected, this inspection must take place within 2 years of its reception. It is nevertheless recommended to carry out this inspection within a period of less than a year following its reception in order to protect the client from all non-conformities and allow him to turn to his service provider in the event of poor workmanship.

During this inspection, the following documents will have to be presented:

  • The architecture of the system showing the various communication protocols used, the controlled systems and their location
  • Functional analysis of the system
  • The lists of points connected to the system
  • The Square Leaf attesting to the training of the managers (s)

Compliance with minimum performance requirements for regulation functions to meet the Bacs decree will be checked.

Regardless of the inspection, the system is also subject to a periodic verification in order to ensure its maintenance in good working order. 

How to prove my compliance? 

  • Certificate of a design office as sober energy through a GTB implantation study or a qualified installer

  • Maintenance invoices or contracts proving the required features

 What if my building is not economically eligible? 

How to justify an exemption? 

By a study demonstrating that the GTB is not profitable over 10 years (time of return on investment> 10 years). The justification for the lack of profitability is based on a calculation of the return on investment time (Sort).

TRI = the additional cost induced by the installation or change of the building automation and control system, expressed in euros - EEC aid

Divided by annual energy savings.

The evaluation of the energy gain induced by the installation or change of the automation and building control system for each energy is carried out on the basis of an average of energy consumption of the last two years for each of the technical systems or by an energy audit and a dynamic thermal simulation.  

How to get financial aid via the EEC?

To obtain the Energy Economies Certificates (EEC), it is minimal that all of the functions meet the requirements of the corresponding EEC sheet, as soon as they are applicable to the building.

The “BAT-PO-116” sheet allows you to benefit from EEC for the installation of a class A or B bins, it is accessible.
